3. USE OF SOFTWARE. Expedition Supply may make certain software available to you from the Site. If you download software from the Site, the software, including all files and images contained in or generated by the software, and accompanying Expedition Supply data (collectively, “Software”) are deemed to be licensed to you by Expedition Supply, for your personal, noncommercial, home use only. Expedition Supply does not transfer either the title or the intellectual property rights to the Software, and Expedition Supply retains full and complete title to the Software as well as all intellectual property rights therein. 4. EXPEDITION SUPPLY’ RESPONSIBILITIES. Expedition Supply, through the Site, provides a platform for users to buy goods and services direct or from other Merchants. Expedition Supply is responsible for the operation of the Site. The Merchant is the seller of the goods or services purchased through the offers made available on the Site. Merchants are established businesses whose performances are monitored to ensure that users receive the appropriate Expedition Supply level of service. These Merchants list their items and assume responsibility for all aspects of their product listings including product descriptions, identification of quantities, establishment of prices, shipping, returns, and refunds. Although Expedition Supply does not own, warehouse, ship or otherwise manage any inventory or goods offered by Merchants, those Merchants who do not meet Expedition Supply’ service standards can and will be removed from listing products on the Site. Expedition Supply handles all payment processing for orders from these Merchants, as well as the assistance in providing a positive experience with the Site and Service.

5. USER CONTENT. You grant Expedition Supply a license to use the materials you post to the Site or Service. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content (“User Content”) to the Site or Service, you are granting Expedition Supply, its affiliates, officers, directors, employees, consultants, agents, and representatives a license to use User Content in connection with the operation of the Internet business of Expedition Supply, its affiliates, officers, directors, employees, consultants, agents, and representatives, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content. You agree not to reproduce, distribute, create derivative works from, publicly display, publicly perform, license, sell or re-sell any data, content, information, software, products or services obtained from or through the Site without the express permission of Expedition Supply. In addition, you may not make any use that exceeds or violates these Terms of Service. 7. COMPLIANCE WITH INTELLECTUAL PROPERTY LAWS. When accessing the Site or using the Service, you agree to obey the law and to respect the intellectual property rights of others. 10. ALLEGED VIOLATIONS. Expedition Supply reserves the right to terminate your use of the Service and/or the Site. To ensure that Expedition Supply provides a high quality experience for you and for other users of the Site and the Service, you agree that Expedition Supply or its representatives may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorized uses of the Site or the Service. 12. TERMS OF SALE. The Merchant must sell the good or service described in its offer to any User who elects to purchase the good or service through the Merchant’s offer. Expedition Supply does not act as agent for either you or the Merchant for any purpose. The “BUY NOW” election available in the offer is a legal offer to buy the good or service displayed. Once the transaction closes, both you and the Merchant are obligated to complete the transaction. By accepting these Terms of Service and making a purchase, you agree to complete the transaction as described by these Terms of Service, you acknowledge that by not fulfilling these obligations, your action or inaction may be legally actionable. If a purchased good is being shipped to a state in which sales tax liability exists, the Merchant must charge sales/use tax on the transaction. You agree that it is the user and the Merchant’s responsibility to determine whether sales or use taxes apply to the transactions and to collect, report and remit the correct tax to the appropriate tax authority. You also agree that Expedition Supply is not obligated to determine whether sales or use taxes apply and is not responsible to collect, remit or report any sales or use taxes arising from any transaction. Because Expedition Supply is not the seller in the actual transaction between a Merchants and a User and is not the agent of either for any purpose, Expedition Supply does not have a duty to resolve and will not be involved in resolving any disputes between participants related to or arising out of any such transaction.

13. SHIPPING POLICY.

Expedition Supply does not own all of the products listed on this site. Our site allows 3rd party sellers/merchants/brands/businesses to promote, sell, and fulfill products & services.

In the unlikely event you need to return an item, please contact the sponsoring merchant or seller directly for details. The return policy varies for each product and merchant who listed it. We can assist you if the seller is not responsive, but do not accept or handle returns as we do not carry the products that are sold on this site.

FOB Origin
All items ships FOB Origin, which means that once we have safely delivered it into the hands of UPS, the Postal Service, FedEx, or another carrier, we are not responsible for any damage, loss or other non-delivery or miss-delivery issues (it does happen, although rarely). We will gladly work with you to help you sort out any problem and to facilitate delivery, but once it is out of ours hands we can no longer be responsible for your item(s). We recommend purchasing the optional insurance if you are concerned about your package.

Address Accuracy and Address Correction:
Our systems automatically ship to the address you provide during checkout. Please ensure its accuracy. We also reserve the right to pass along to you any fees assessed by the carrier to address-correct your package once it is underway. If you provide an inaccurate address or your package is refused or returned for any reason that is not our fault, we will not refund you the shipping costs and may assess an additional charge if the carrier charges us to return the item to us (a common UPS practice). If you want us to re-ship your item, you will have to pay shipping costs a second time. If you do not want it re-shipped, we will treat your package as if it was a return.

Free Shipping Promotions
We occasionally offer free shipping promotions. Free shipping applies ONLY to domestic U.S. shipping addresses and may not include Hawaii, Alaska, Puerto Rico, APO and other address outside the lower 48 states. If you return an item that was shipped with free shipping, we will deduct the cost of shipping that item from the amount of your refund.
