Products and services may be purchased by you directly from Merchants using the Site, subject to these Terms of Service, as well as the terms of the offer disclosed to you at the time of purchase. Merchants are responsible for all aspects relating to fulfillment of the offer, not Expedition Supply. Use of the Services is void where prohibited. You must be 18 years old and able to form a legally binding contract to be eligible to use Expedition Supply’ Services. Certain areas of the Site may require you to create an account with Expedition.Supply or may otherwise ask you to provide information to participate in certain features or access certain content. The decision to provide this information is purely optional; however, if you elect not to provide such information, you may not be able to access certain content or Services, or participate in certain features of the Site.
2. ACCOUNTS. You are required to create an account in order to make a purchase through the Site. When you create your account, you must complete the registration process by providing the complete and accurate information requested on the registration form. You will also be asked to provide a username and password. You are entirely responsible for maintaining the confidentiality of your password. You may not use the account, username, or password of someone else at any time. You agree to notify Expedition Supply immediately of any unauthorized use of your account, username, or password. 3. USE OF SOFTWARE. Expedition Supply may make certain software available to you from the Site. If you download software from the Site, the software, including all files and images contained in or generated by the software, and accompanying Expedition Supply data (collectively, “Software”) are deemed to be licensed to you by Expedition Supply, for your personal, noncommercial, home use only. Expedition Supply does not transfer either the title or the intellectual property rights to the Software, and Expedition Supply retains full and complete title to the Software as well as all intellectual property rights therein. You may not sell, redistribute, or reproduce the Software; decompile, reverse-engineer, disassemble, or otherwise convert the Software to a human-perceivable form; perform meta-searches of the website or the service; or send automated queries to the website or the service. All trademarks and logos are owned by Expedition Supply or its licensors and you may not copy or use them in any manner.
4. EXPEDITION SUPPLY’ RESPONSIBILITIES. Expedition Supply, through the Site, provides a platform for users to buy goods and services direct or from other Merchants. Expedition Supply is responsible for the operation of the Site. The Merchant is the seller of the goods or services purchased through the offers made available on the Site. Merchants are established businesses whose performances are monitored to ensure that users receive the appropriate Expedition Supply level of service. These Merchants list their items and assume responsibility for all aspects of their product listings including product descriptions, identification of quantities, establishment of prices, shipping, returns, and refunds. Although Expedition Supply does not own, warehouse, ship or otherwise manage any inventory or goods offered by Merchants, those Merchants who do not meet Expedition Supply’ service standards can and will be removed from listing products on the Site. Expedition Supply handles all payment processing for orders from these Merchants, as well as the assistance in providing a positive experience with the Site and Service.
5. USER CONTENT. You grant Expedition Supply a license to use the materials you post to the Site or Service. By posting, downloading, displaying, performing, transmitting, or otherwise distributing information or other content (“User Content”) to the Site or Service, you are granting Expedition Supply, its affiliates, officers, directors, employees, consultants, agents, and representatives a license to use User Content in connection with the operation of the Internet business of Expedition Supply, its affiliates, officers, directors, employees, consultants, agents, and representatives, including without limitation, a right to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat User Content. You will not be compensated for any User Content. You agree that Expedition Supply may publish or otherwise disclose your name in connection with your User Content. 6. OWNERSHIP OF SITE. The content and information on the Site and Service, as well as the infrastructure used to provide both, is proprietary to Expedition Supply, its Users, Merchants and other partners. Expedition Supply grants you a limited, personal, nontransferable, nonexclusive, revocable license to access and use the Site pursuant to these Terms of Service and to any Additional Terms and policies set forth by Expedition Supply. You agree not to reproduce, distribute, create derivative works from, publicly display, publicly perform, license, sell or re-sell any data, content, information, software, products or services obtained from or through the Site without the express permission of Expedition Supply. In addition, you may not make any use that exceeds or violates these Terms of Service. Nothing contained on the Site should be understood as granting you a license to use any of the trademarks, service marks, or logos owned by Expedition Supply or by any third party.
7. COMPLIANCE WITH INTELLECTUAL PROPERTY LAWS. When accessing the Site or using the Service, you agree to obey the law and to respect the intellectual property rights of others. Your use of the Service and the Site is at all times governed by and subject to laws regarding copyright ownership and use of intellectual property. 9. COPYRIGHT INFRINGEMENT. Expedition Supply has in place certain legally mandated procedures regarding allegations of copyright infringement occurring on the Site or with the Service. Expedition Supply has adopted a policy that provides for the immediate suspension and/or termination of any Site or Service user who is found to have infringed on the rights of Expedition Supply or of a third party, or otherwise violated any intellectual property laws or regulations. 10. ALLEGED VIOLATIONS. Expedition Supply reserves the right to terminate your use of the Service and/or the Site. To ensure that Expedition Supply provides a high quality experience for you and for other users of the Site and the Service, you agree that Expedition Supply or its representatives may access your account and records on a case-by-case basis to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorized uses of the Site or the Service. Expedition Supply does not intend to disclose the existence or occurrence of such an investigation unless required by law, but Expedition Supply reserves the right to terminate your account or your access to the Site immediately, with or without notice to you, and without liability to you, if Expedition Supply believes that you have violated any of the Terms of Service, furnished us with false or misleading information, or interfered with use of the Site or the Service by others.
11. OFFER DESCRIPTIONS AND PRICING. The description of a good or service featured in an offer on the Site is supplied by other Merchants making the offer. Expedition Supply does not warrant that product descriptions or other content supplied by other Merchant is error-free. If a product made available on the Site is not as described by the Merchant, you agree to resolve the dispute directly with the Merchant. Except where noted otherwise, the value displayed for the goods or services described in an offer on the Site is provided by the Merchant and represents the full retail price of goods or services, as suggested by the manufacturer or supplier, estimated in accordance with standard industry practice, or estimated in accordance with comparable goods or services offered elsewhere. The value is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day.
12. TERMS OF SALE. The Merchant must sell the good or service described in its offer to any User who elects to purchase the good or service through the Merchant’s offer. Expedition Supply does not act as agent for either you or the Merchant for any purpose. The “BUY NOW” election available in the offer is a legal offer to buy the good or service displayed. Once the transaction closes, both you and the Merchant are obligated to complete the transaction. By accepting these Terms of Service and making a purchase, you agree to complete the transaction as described by these Terms of Service, you acknowledge that by not fulfilling these obligations, your action or inaction may be legally actionable. If a purchased good is being shipped to a state in which sales tax liability exists, the Merchant must charge sales/use tax on the transaction. You agree that it is the user and the Merchant’s responsibility to determine whether sales or use taxes apply to the transactions and to collect, report and remit the correct tax to the appropriate tax authority. You also agree that Expedition Supply is not obligated to determine whether sales or use taxes apply and is not responsible to collect, remit or report any sales or use taxes arising from any transaction. Because Expedition Supply is not the seller in the actual transaction between a Merchants and a User and is not the agent of either for any purpose, Expedition Supply does not have a duty to resolve and will not be involved in resolving any disputes between participants related to or arising out of any such transaction.
13. SHIPPING POLICY.
Expedition Supply does not own all of the products listed on this site. Our site allows 3rd party sellers/merchants/brands/businesses to promote, sell, and fulfill products & services.
In the unlikely event you need to return an item, please contact the sponsoring merchant or seller directly for details. The return policy varies for each product and merchant who listed it. We can assist you if the seller is not responsive, but do not accept or handle returns as we do not carry the products that are sold on this site.
All items ships FOB Origin, which means that once we have safely delivered it into the hands of UPS, the Postal Service, FedEx, or another carrier, we are not responsible for any damage, loss or other non-delivery or miss-delivery issues (it does happen, although rarely). We will gladly work with you to help you sort out any problem and to facilitate delivery, but once it is out of ours hands we can no longer be responsible for your item(s). We recommend purchasing the optional insurance if you are concerned about your package.
Address Accuracy and Address Correction:
Our systems automatically ship to the address you provide during checkout. Please ensure its accuracy. We also reserve the right to pass along to you any fees assessed by the carrier to address-correct your package once it is underway. If you provide an inaccurate address or your package is refused or returned for any reason that is not our fault, we will not refund you the shipping costs and may assess an additional charge if the carrier charges us to return the item to us (a common UPS practice). If you want us to re-ship your item, you will have to pay shipping costs a second time. If you do not want it re-shipped, we will treat your package as if it was a return.
Free Shipping Promotions
We occasionally offer free shipping promotions. Free shipping applies ONLY to domestic U.S. shipping addresses and may not include Hawaii, Alaska, Puerto Rico, APO and other address outside the lower 48 states. If you return an item that was shipped with free shipping, we will deduct the cost of shipping that item from the amount of your refund.

Because neither Expedition Supply nor the Site has control over the content and performance of these Third-Party Sites, Expedition Supply makes no guarantees about the accuracy, currency, content, or quality of the information provided by such sites, and Expedition Supply assumes no responsibility for unintended, objectionable, inaccurate, misleading, or unlawful content that may reside on Third-Party Sites. 19. INDEMNITY. You agree to indemnify Expedition Supply for your acts and omissions. 20. GOVERNING LAW. These Terms of Service shall be construed in accordance with and governed by the laws of the United States and the State of Utah, without reference to their rules regarding conflicts of law. You hereby irrevocably consent to the exclusive jurisdiction of the state or federal courts in Davis County, Utah, USA in all disputes arising out of or related to the use of the Site or Service.
21. SEVERABILITY; WAIVER.
